KLRCA Now Has Arbitration Rules For Islamic Banking, Financial ...

KUALA LUMPUR, March 27 (Bernama) -- The Kuala Lumpur Regional Centre for Arbitration (KLRCA) today introduced the arbitration rules for its Islamic Banking and Finacial Services (KLRCA IBFS). It provides players with guidelines for the settlement of disputes arising from the syariah aspect of Islamic banking and Islamic financial services. Legal counsel Datuk Noorashikin Tan Sri Abdul Rahim said the Malaysian courts are available as an arena for hearing disputes arising out of transactions in relation to the Islamic banking and financial services. The last link in the chain of the Islamic banking and financial services must surely be a dispute resolution service particularly in the form of arbitration, she noted in a statement. Noorashikin described arbitration as the most favoured form of dispute settlement as it allows parties to determine their own procedure for settling their dispute.


YET ANOTHER ASUU STRIKE

THERE may be some sort of relief to be found in the aptness of the remark by the President of the Academic Staff Union of Universities (ASUU), Dr. Abdullahi Sule-Kano, while announcing the commencement of an indefinite strike, that the union took the decision "with deep pain after long patience spanning two years." But if Dr. Sule-Kano for a moment imagines that the "deep pain" is felt only by his union, ASUU, then he is wrong.

THE pain of an indefinite strike by ASUU is not being borne by ASUU alone, it is shared by the students, their parents and employers of labour; all of them are inexorably affected by the industrial strike. The students’ and their parents’ pain will derive from the undue extension of the period the students have to spend on their various courses. But the employers of labour have so much more to worry about; they are left to ponder on the quality of manpower being released into the labour market after disrupted academic sessions in the universities.

I have to listen much. I have been inspired by the works of Fisher and Ury, notably Getting to yes. This book explains that a good agreement is one, which is wise and efficient and which improves the parties' relationship. Mediators use appropriate techniques and skills to open, improve dialogue between disputants, aiming to help the parties reach an agreement (with concrete effects) on the disputed matter. Normally, all parties must view the mediator as impartial. Mediation can apply in a variety of disputes. These include commercial, legal, diplomatic, workplace, community and divorce or other family matters.


Paris company to send mediator over French Polyensia strike

The French company Cegelec is to send a top official from Paris to French Polynesia in a bid to negotiate a solution to a protracted stand-off involving staff at its Papeete affiliate.

Workers at the Tahiti branch have been in strike in protest at planned dismissals.

The territorial government has received union representatives who want government support to stop any sackings.

Earlier this week, Cegelec workers blocked the access to the Papeete port but lifted the blockade after warnings that riot police would clear the access.

The strike comes amid other industrial action of construction workers at the site of the new hospital, petrol company employees and staff of a phone company.

Municipal workers in one town are also on strike.
